These Terms of Service ("Terms") govern your access to and use of the Yoma mobile application, this website, and the waitlist (the "Service"), operated by DFN Studio ("Yoma", "we", "us"). By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms.
1. The Service
Yoma is a marketplace that connects people looking for a place to rent in Cameroon ("Seekers") with property owners ("Owners"). Yoma is a platform; we are NOT a real estate agency, broker, landlord, or party to any rental contract between users.
2. Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) and able to enter into a binding contract. By using the Service, you confirm that you meet these requirements.
3. Accounts
• You must provide accurate information when creating an account. • You are responsible for all activity under your account and for keeping your phone, OTP codes, and credentials confidential. • One person, one account. You may not transfer or share your account. • Owners must complete an approval process before being able to publish more than one listing. We may approve, reject, or revoke Owner status at our discretion.
4. Waitlist
Joining the waitlist is free and creates no obligation to use the Service. By submitting your phone number, you consent to receive launch-related SMS and email communications. You can opt out at any time.
5. Listings (for Owners)
Owners are solely responsible for the content of their listings, including photos, videos, addresses, prices, availability, and the truthfulness of the information provided. By submitting a listing, you grant Yoma a worldwide, non-exclusive, royalty-free license to host, display, and promote the listing within the Service. You agree NOT to publish: • Properties you are not authorized to rent out. • Misleading photos, videos, or descriptions. • Discriminatory content (race, religion, gender, disability, family status, sexual orientation, or any other protected characteristic). • Duplicates or fake listings. • Properties at illegal addresses or that violate local zoning, safety, or housing laws.
6. Bookings, payments, and deposits
Yoma facilitates introductions between Seekers and Owners. Any rental agreement, deposit, or payment is concluded directly between the Seeker and the Owner. Yoma is not a party to that agreement and is not liable for its performance, the condition of the property, or any dispute between the parties. We strongly recommend visiting a property before paying any deposit and using a written rental contract.
7. AI Emergency Search Assistant
The AI Emergency Search Assistant scans available listings and, on your behalf, automatically sends an initial inquiry message to up to 5 matched Owners. By using this feature, you authorize Yoma to send such messages from your account. You remain responsible for the conversations that follow.
8. Community rules
You agree NOT to: • Harass, threaten, defame, or discriminate against other users. • Send spam, scams, or unsolicited promotional content. • Impersonate another person or misrepresent your affiliation with anyone. • Circumvent the in-app messaging system to defraud users. • Use the Service for illegal purposes or in violation of any law. • Attempt to reverse-engineer, decompile, or scrape the Service. • Upload viruses, malware, or any harmful code. We may remove content, suspend, or terminate accounts that violate these rules, with or without notice.
9. Reports and moderation
Users can report listings or other users via the in-app reporting tool. Our moderation team reviews each report. False or malicious reports may lead to sanctions.
10. Intellectual property
The Service, including its software, logos, branding, and design, is owned by DFN Studio. You may not copy, modify, or create derivative works without our written permission. You retain ownership of the content you submit (listings, photos, messages), subject to the license granted in section 5.
11. Third-party services
The Service uses third-party providers (Google Maps, Google Sign-In, push notification services, SMS/email providers, cloud hosting, analytics). Their use is subject to their own terms; we are not responsible for their services.
12. Suspension and termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, applicable law, or in case of fraud or abuse. You may delete your account at any time from "Account Settings → Deactivate Account".
13. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, Yoma disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that listings will be accurate.
14. Limitation of liability
To the maximum extent permitted by law, Yoma will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the event giving rise to liability, or (b) XAF 50,000.
15. Indemnification
You agree to defend, indemnify, and hold harmless Yoma and its affiliates from any claim, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
16. Changes
We may update these Terms. We will post the new version with an updated "Last updated" date. Material changes will be communicated through the app, website, or by email/SMS. Continued use of the Service after changes means you accept the new Terms.
17. Governing law and disputes
These Terms are governed by the laws of the Republic of Cameroon. Any dispute arising out of or related to the Service shall be submitted to the competent courts of Douala, Cameroon, unless mandatory consumer-protection law provides otherwise.
